0. Plain-language summary
- Deutschkurs Wien is an independent business. Browsing the site is free. We earn from clearly-labelled sponsored placements, lead-generation, school portal subscriptions, and (when active) display advertising. We do not sell courses ourselves — bookings are always concluded directly with the school.
- We try hard to be accurate, but we don't guarantee anything. Always confirm prices and dates with the school before you pay.
- You can use this site for any lawful purpose — read it, link to it, recommend it.
- You may not abuse it: don't scrape it aggressively, don't try to break our auth, don't submit fake school listings, don't reuse our content commercially without our written permission.
- If you have a school portal account, you're responsible for your account credentials, for the accuracy of the data you submit, and (for paid customers) for the contractual terms of your subscription or advertising order.
- Disputes are governed by Austrian law and heard in Vienna; consumer protections under the KSchG remain unaffected.
1. Scope
These Terms of Use ("Terms") govern your use of the Deutschkurs Wien website (the "Site"), the school portal accessible from it, and any related sub-domains operated by us (collectively, the "Service"). 2. Use of the Service
The Service is an independent commercial directory of German language courses in Vienna. Browsing the public site is free of charge. The display of school listings on the public site does not constitute an offer by us to conclude a course contract; course bookings are concluded exclusively between you and the respective language school, on the school's own terms.
You may use the Service for any lawful personal purpose, including reading the listings, linking to specific course pages, and sharing them. Commercial re-use of our content, automated harvesting, or systematic extraction of the underlying database requires our prior written permission (see § 5).
3. Accuracy and availability
Course data is collected automatically from each school's public website or submitted by the school directly via the school portal. We update the data once daily. We do not guarantee the accuracy, completeness, or timeliness of any information displayed on the Service. Prices, dates, schedules, and availability are subject to change at any time without notice to us. The respective school is the authoritative source.
The Service is provided "as is" and "as available". We do not warrant uninterrupted availability and we may temporarily or permanently suspend, change, or discontinue any part of the Service at any time, with or without notice.
4. School portal — additional terms for registered users
If you create an account at the school portal, the following additional terms apply:
4.1 Eligibility and identity
You may only register if you have authority to represent the school whose listing you intend to manage. By submitting your registration, you confirm that:
- You are over 18.
- You are authorised by the school to manage its listing.
- The information you submit is true, complete, and not misleading.
- The verification document you attach genuinely demonstrates your authority.
4.2 Account security
You are responsible for keeping your password (or Google account, if used for federated login) secure and for all activity on your account. Notify us immediately at [YOUR-EMAIL] if you suspect unauthorised access.
4.3 Content you submit
You retain all rights to the content you submit through the portal (school description, course details, schedules, etc.). By submitting it you grant us a non-exclusive, royalty-free, worldwide licence to display, store, distribute, and back up that content as part of the Service, including via the public GitHub repository. This licence ends when you delete the content or your account, with the exception that we may retain historical entries in our audit log for security and dispute-resolution purposes.
You warrant that the content you submit does not infringe third-party rights, contain misleading claims, or violate applicable law (including the Austrian Unfair Competition Act, UWG).
4.4 Acceptable use
You agree not to:
- Submit data for a school you do not represent.
- Promote unlabelled paid content, hidden sponsorships, or undisclosed referral arrangements through the portal — all paid placements must be ordered through our official advertising channel ([YOUR-EMAIL]) and will be displayed with the required "Anzeige · Sponsored" label.
- Attempt to gain access to other users' accounts or to administrative functions you are not authorised for.
- Use automated tools (bots, scripts) to interact with the Service beyond reading the public data via documented channels at a reasonable rate.
- Submit malicious content, spam, defamatory statements about competitor schools, misleading claims, or content that violates the rights of third parties or applicable law (including the UWG).
4.6 Paid products — sponsored placements, lead generation, premium portal subscriptions
If you order a paid product (a sponsored placement, lead-generation package, or premium portal subscription), the order confirmation we send you sets out the specific term, fees, payment schedule, and cancellation conditions of that order. In case of conflict between these Terms and an individual order confirmation, the order confirmation prevails.
Sponsored content labelling. All paid placements are visibly labelled "Anzeige · Sponsored" or equivalent in accordance with § 26 Mediengesetz and the Austrian UWG. We reserve editorial control over placement, format, and rejection of content that does not meet our labelling standards or that we consider misleading.
Cancellation / Widerrufsrecht. Paid products are B2B services. Where the customer is not a consumer under § 1 KSchG, no statutory 14-day withdrawal right under the FAGG applies; cancellation terms follow the order confirmation. For school portal accounts opened by a consumer (rare), the statutory 14-day right of withdrawal under § 11 FAGG applies and you may withdraw by writing to [YOUR-EMAIL].
Refusal to publish. We reserve the right to refuse or remove any paid placement that, in our reasonable judgment, would expose us to legal risk, mislead users, harm the reputation of the Service, or violate our editorial standards. In such cases pre-paid fees are refunded pro rata.
4.5 Termination and suspension
We may suspend or terminate your account at our discretion if you breach these Terms, if false information was submitted at signup, if the school you represent withdraws your authorisation, or if continued operation of your account would expose us to legal risk. We will make reasonable efforts to notify you in advance and, where applicable, give you a chance to remedy the issue.
You may close your account at any time by emailing [YOUR-EMAIL]. Course data you have submitted may remain in the public repository unless removal is specifically requested and there is no legal obligation to retain it.
5. Intellectual property
5.1 Source code and design
All source code, design, layout, graphics, and editorial text of the Service are © Deutschkurs Wien and protected under Austrian and EU copyright law. No licence to copy, modify, reverse-engineer, or redistribute is granted to you by virtue of accessing the Service. Internal viewing of the page source code in your browser for security-research or accessibility purposes is permitted within the scope of § 42 UrhG.
5.2 Course data and aggregated database
Individual course data (titles, prices, schedules, descriptions) belongs to the respective schools. Re-publication of meaningful extracts beyond the citation right (Zitatrecht, § 42f UrhG) requires permission from the originating school. The aggregated database itself — the selection, normalisation, structure, and ongoing curation of all listings — represents a substantial investment by us and is protected as a database under § 76c UrhG (EU Database Directive 96/9/EC, sui generis right). Commercial extraction or re-utilisation of all or a substantial part of the database, or repeated extraction of insubstantial parts, requires our prior written consent.
5.3 Marks
Third-party names and marks used in the listings ("Goethe-Zertifikat®", "Berlitz®", "ÖSD®", school names, etc.) are the property of their respective owners and are used solely for editorial identification of the relevant services.
6. Liability
To the maximum extent permitted by Austrian law:
- We exclude liability for slight negligence (leichte Fahrlässigkeit) in respect of consequential damages, lost profits, lost data, and indirect damages.
- Liability for damages caused by gross negligence or intent (grobe Fahrlässigkeit / Vorsatz) remains in full as provided by § 1295 ABGB.
- Liability for personal injury (life, health, body) is unaffected by these Terms.
- Mandatory consumer-protection rights under the Austrian Konsumentenschutzgesetz (KSchG) are unaffected by these Terms.
We are not liable for the conduct of language schools or their compliance with any contracts you may conclude with them. Disputes about a booked course (cancellation, refunds, course quality, etc.) must be resolved with the school, not with us.
7. Third-party services
The Service relies on third-party providers — Hetzner Online GmbH (hosting), GitHub (private code repository), Google (Translate, Places API), our payment processor (school portal subscriptions and advertising orders), and an advertising network (when activated). Those providers operate under their own terms; their availability or behaviour is outside our control. If a third-party service is unavailable, the affected feature of our Service may be temporarily unavailable too. Full data-protection disclosures are in our Privacy Policy.
8. Changes to these Terms
We may amend these Terms when the Service materially changes, when legal requirements evolve, or when we identify issues with the existing text. The current version is always available at this URL together with the date of the last update. Material changes affecting registered portal users will be communicated by email at least 30 days before they take effect; portal users who do not accept the changes may terminate their account before the effective date.
9. Governing law and jurisdiction
These Terms are governed by Austrian law, excluding its conflict-of-laws provisions and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes arising out of or in connection with these Terms is the competent court at Wien (Vienna), Austria. For consumers within the meaning of § 1 KSchG, the statutory places of jurisdiction provided by Austrian law remain unaffected; nothing in these Terms deprives a consumer of mandatory protections under the law of the country where they have their habitual residence.
10. Severability
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as possible to the economic intent of the original.
